2:05 PM PT — Both Sam Lutfi and Jamie Spears showed up to the hearing. Jamie’s legal team declared the intention to call both Jamie and Lutfi to the stand for testimony.

Because of the nature of what may be discussed, including sensitive information concerning Britney’s condition, Jamie’s team asked that the courtroom be sealed.

Britney’s attorney argued that the singer has a greater vulnerability to being damaged if she sees information online about her condition and the conservatorship. The judge sided with Spears and sealed the courtroom.


Britney Spears‘ former manager is fighting back against her attempt to get a permanent restraining order against him, claiming it violates his First Amendment rights.

Sam Lutfi is due in court this afternoon to argue against a permanent restraining order being put in place that would bar him from coming within 200 yards of Spears and her family.

 
 

According to court documents obtained by The Blast, Lutfi claims that trying to prevent him from making “any disparaging public statements” against Spears and her family is “an unconstitutional prior restraint on speech that has not been adjudicated as defamatory.”

He claims the TRO request is too vague and argues that critical speech about Spears is not the same as something said to her.

“Something as innocuous as saying that he does not care for one of Ms. Spears’ songs, or stating something factually truthful about her, could subject Mr. Lutfi to criminal penalties,” he argues.

In the docs, Lutfi expands on that idea, saying. “Such an order is vague and ambiguous as to what Mr. Lutfi can and cannot permissibly say. What exactly does ‘disparaging’ mean? Would Mr. Lutfi face criminal prosecution if he publicly states that he does not like one of Ms. Spears’ songs? What if he simply states that one of her new songs is not as good as one of her old songs? What if Mr. Lutfi states something factually true about Ms. Spears, but it is potentially embarrassing? Something factually true cannot be defamatory, but it could be disparaging.”

He also argues that his messages to Lynne Spears do not rise to the level of harassment against Britney. He says that none of those messages were directed at Britney herself and argues that “Ms. Spears could simply have blocked Mr. Lutfi on Twitter, and asked her mother not to show her any more text messages that she received from Mr. Lutfi.”

Both sides are due in court later today.

 

Their argument is is weak because they've been directly feeding People and TMZ info on her condition and the Conservatorship since the movement began:idgi:

I hope she does a Netflix documentary and expose everything. Then release songs that describe what she was going through.

If she is going to expose everyone..... don't do it on Netflix.... do it on ABC, NBC, or CBS.  A platform that doesn't require a subscription.  This way everyone knows that she wants EVERYONE to know the truth.

lol Jamie is playing himself, but i doubt the judge cares. Exhibit "A" is the instagram video of her saying she's ok and posting that the emails from Sam were not real. Exhibit "B" is today's post of her saying the rumors of her not posting are false. in each video she is disputing online rumors and she doesn't appear distraught about either rumor so that goes against his argument and also shows that the conservatorship isn't even being used correctly. It's being used as a form of personal security and not for an "alleged" mental condition. She shouldn't be in a conservatorship to hide from people. She's a celebrity it comes with the job. That's what Security companies and bodyguards exist for.

:tiffeyeroll: Ofc the judge will side with James and grant this permanent restraining order. What a waste of time and Britney's money this court date is. And she's not even there to say if SHE wants that restraining order to be put in place to begin with. Osama is obviously trash but Team C-ship serving everybody who openly criticises the conservatorship or tries to get in touch with Britney a restraining order is soo f**king fishy. They literally think they're invincible. I hope the investigation will destroy their ***** once and for all.

They do speak...They are not BFFs but they do speak. Obviously Lynne won’t reveal sensitive info to him, but you are deceiving yourself if you think they don’t talk.

Theres no need for a 'comeback'. Britney was the highest paid performer in Vegas before this all started. If she wanted to do an actual world tour, there is no doubt that it would be successful.  Album and single sales aren't big money makers when you can make the large sums of money Britney makes from performing live shows.

Unless Britney is getting released from the conservatorship, there is nothing to come back from. Success wise, all is great in Britney Land.
