Thomas Girardi-another high profile person has been just placed under permanent CONservatorship!

I live in Europe and my brother is under a conservatorship because he has down syndrom (my father is the conservator) 

But my father doesn't gain anything from it. My brother doesn't pay him whatsoever, there is no conflict of interest like in the US :gerlwat_sunglasses_cigarette_looking_what_blink:

And my brother doesn't work anyway.

That man is almost 90 years old in his case it’s justifiable. He’s been diagnosed well before it was file by his brother, so I hope this is a good one & not one to take advantage. Plus this Erika Jane husband, he probably plan it because he’s being sued by a lot of people over a scheme he pull on them. It’s a lot with his situation & he’s very clever. As we remember Britney couldn’t be sued for awhile because of the conservatorship, so I think that’s what he’s doing

There are situations where a cship is warrant, say when someone has dementia or extreme cases of disabilities where they can't remember or say things anymore. However the threshold needs to be very high and reforms are needed. 

 

Here in Brazil we do have something similar, it's called Curatela.

Not to discredit anything that has been said, but I’d look further into this case.
 

Tom Girardi and his estranged wife Erika Jayne from real housewives  are in the middle of many multi million dollar lawsuits. His law firm was embezzling large settlements from victims who won in class action suits, from major tragedies.  He was caught funneling money into his wives accounts before they separated. There is speculation that this conservatorship is to protect money and make him look innocent. 
 

also he is very high up socially and friends with all the judges. He used to hold a position in appointing them.

Oh, it does happen in Europe, too. And it does get abused too, don't let anyone tell you otherwise. It just has a different name where I live. You get a professional conservator (I'll just use that term because I have no idea what else to call it) who get paid to take care of your medical things. Depending on how much power the judge gives them, they're also responsible for financial things, housing, mail etc.
I would know because I was placed under one after a long stay in a psychiatric facility. So it does happen and it does happen against your will if you don't agree. Having said that, that doesn't mean it's always bad. Me personally, I didn't notice it most of the time. And it was very easy for me to end it once I got better. But I'm not a high profile person. And I wasn't stalked 24/7. These cases are always the worst with people who have money, they're the easiest to abuse unfortunately and just because Europe has a different name for it doesn't mean it doesn't happen. That whole system needs to be thought over.

That is not the concept of a conservatorship though, that is mismanagement of a conservatorship. Conservatorships are meant for people who cannot care for themselves, the point is to ensure they still have roof over their head, food, medical care etc. Not sure how extensively you have looked in your personal research or what it consisted of, but there are cases of successful cships (or the equivalent by another name), not all are mismanaged where the conservatee is isolated or mistreated. But like I said, I agree they need to be majorly reformed to protect those who need to be in one and to ensure individuals who don't need it are not put into it but offered other solutions fit to their needs. The concept in and of itself is still valid though, we know there are people who cannot care for themselves and never will be able to (and not talking about silly things like not brushing your teeth, but who would end up on the street or dead if they don't receive support), and as a society we want to ensure they are cared for.
