The truth is you have no idea how or what Britney and Rosengart discussed. So this is all assumptions.

Britney is still retaining his counsel and seeing how short is her fuse lately, I assume he would have gotten the boot pretty quickly if he was poopy.

a fact many people forget in their criticism of rosengart! she can fire him anytime she wants to, she has not and that speaks volumes. 

as for the reason it took him 3 months to request a new depo, there can be a number of factors— britney is not his only client, the depo is not the only part of this case he's working on, after trying to make sense of what evidence they were given they realized it was hopeless and needed further orders, etc.

i think that depending on the powers granted to the referee (limited or full) this could potentially help move things along faster! if limited the referee would just make a conclusion to penny for her to then make a decision (similar to the probate notes) and if full they would make the decision themselves. let's hope they go the full route, and at least the discovery matters can be totally bypassed by penny.
