Will #FreeBritney go the same way as FreeDannyTate Movement?

Here's a 'success' story of another musician with a fanbase movement that helped put pressure leading to the end of a conservatorship with some clear links and similarities to Britneys story. 

This is a story of how an errant judge and a controlling sibling stripped Nashville rocker Danny Tate of his money, his livelihood and his legal rights. John Daniel "Danny" Tate is an American musician, songwriter, composer, producer, and former Virgin Records recording artist, best known for penning songs covered by Jeff Healey, Tim McGraw, Billy Ray Cyrus, The Fabulous Thunderbirds, Patti LaBelle and many others. Danny Tate never dreamed the power of attorney intended for use by his brother David to pay bills while Danny was in rehab would instead be used to initiate and finance a conservatorship action legally stripping the musician of both his personal and property rights.

Danny's brother David, president of a successful Memphis product promotions company, was named conservator of Danny's estate in October 2007 after he convinced Judge Kennedy that his brother was a crack addict so desperate he was facing death.


The initial freezing of Tate’s assets was reportedly granted in an ex parte “emergency” conservatorship hearing of which Tate was not aware (same as Britney). This freeze thwarted Tate’s hiring of counsel and provided Dr. William Kenner, a child psychiatrist without addiction medicine certification, opportunity at the permanent conservatorship hearing to pronounce Tate as “disabled” with no challenge to Kenner’s lack of credentials, brief investigation and questionable testimony.

After just two or so years of conservatorship activity it was reported that Danny Tate’s $615,000 estate was reduced to about $175,000. Yet Danny Tate was far from a deadbeat. Though never attaining major “front man” commercial success, Tate is as an accomplished songwriter with decades of recognized marketability. Tate had found a lucrative niche composing music for shows such as Entertainment Tonight and the Ellen DeGeneres Show. Between current jobs and royalties, he was reportedly making quite a comfortable living until the confiscation of his recording equipment via the conservatorship.

Tate’s friend Kevin Montgomery, a self-described world-traveling singer-songwriter/adventurist/dad, was so moved by the injustice that he blogged about it as well as helped organize the Friends for Danny Tate’s Defense Facebook group. The group had well over 2,000 members and was selling “Free Danny Tate” t-shirts and held an awareness concert in May 23 2010

Then later in 2010 - the courtroom was packed with people wearing T-shirts reading “Free Danny Tate.” Supporters traveled from as far as Washington, D.C., and Key West, Fla., to show their support. They applauded loudly when Danny Tate entered the courtroom for the hearing that Monday morning.

Danny Tate’s lawyer said that psychiatrists have found Danny Tate competent to handle his own affairs, and the lawyer asked to dissolve the guardianship.

“It was just a big victory for me, as an American citizen, to be able to make my own choices,” said Danny Tate. Although Danny regained his rights, conservation has Consumed $200,000 Of Danny’s Tate’s Savings. Subsequently he was also ordered to pay not only his own legal bills but also his brother's post conservatorship leading him to bankruptcy.There is one group, however, that emerges from this story as a clearcut winner: the attorneys. Paul Housch, David's attorney for the conservatorship, has billed roughly $100,000 since October 2007. Danny's attorney, Michael Hoskins, has also run up an expensive tab since he was hired in the fall of 2008.Perhaps saddest of all, there is also a clear and possibly permanent loser: the relationship between the Tates. As David left the courtroom, the brothers did not look at one another. They did not address each other, or mutter even a perfunctory greeting. For now, the brothers remain locked in a kind of détente. One insists he saved his younger brother's life. The other insists his older brother tried to take it away.

Some of your information is not accurate and needs to be corrected. You can read all the following facts in Danny Tate’s two books “Fugitive from Injustice” Book One and Book Two, available on Amazon. (Links below). (Danny’s conservatorship was and is a horror story compared to Britney’s.)

The article "Court Ordered Hell" is misleading on many levels. Firstly, it implies that Danny Tate signed the Power of Attorney on his own accord, which was not what happened. Danny was tricked into signing a fraudulent POA that his brother used to clean out Danny’s bank accounts, and then accused Danny of spending that money on an alleged **** habit, for which there was no evidence, but which became the basis for the Conservatorship.


Danny’s estate’s value in May 2007, was at least $3 million, not $650,000. It does not account for the value of his home, the $250,000 - $350,000 per year royalty income that came in during the court of the conservatorship. It doesn't account for the fact Danny just had two of his publishing catalogs appraised at $1,000,000, nor does it account for the value of other publishing catalogs that reverted back to him during the course of the conservatorship which were more valuable than the two he owned at the initiation of conservatorship. If his career and investments had not been sabotaged by an illegal conservatorship, his estate today would be worth $10 to 15 million. Instead, he was left homeless, broke, $500,000 in debt, with no career and no end in sight. It didn't just gut his estate, it ruined him personally, professionally and financially. 


Kevin Montgomery was not a close friend and did not have the Free Danny Tate t-shirts printed up. Martha Warnock Kyzer (who also edited Fugitive from Injustice) was the one who had the t-shirts printed up. Kevin was only out to make money. On his website, he has a button for people to contribute money to him (for no apparent reason) by buying him a "cup of coffee". Kevin turned the Free Danny Tate cause to focus on himself. NASGA also turned predatory and made money off selling t-shirts. NASGA has their own self-serving agenda.


No one has worked as hard as DT in exposing Conservatorship abuse. Danny has testified before two congressional hearings in DC, was the first victim to speak about it at the National Whistleblowers Summit in DC in 2016, has helped countless other victims, and has written the following two books chronicling his victimization:

He was out after about 3 years then Britney is 13 and still on. This is why it is so hard to say anything about dissolving cship. Then it comes to situations like that i think at some point conservator does have some good intentions in heart. It is just money that makes them thinking more about themselvs than conservatee. Like with Britneys case we know she was in a bad state in 2007 and she might need help or guardianship temporarily. The main mystery is why they did it permanent then she is clearly in no need to it now.

Also Britney had multiple contracts and endeveurs which made her estate financially successfull. While This mans brother clearly mismanaged his money .  no1 can find evidence(or bring it yet) about Britneys father mismanaging her. This is why we can't be so optimistic. Even the fact he raised payment to lou then Britney wasn't performing wasn't enough for the court

No Danny Tate is NOT "out" of his conservatorship. He is still under conservatorship - going on 14 years. Irreparable damage, including PTSD legal abuse syndrome, has been done.

 

No, it was not a "mismanagement of money" (and Danny Tate’s estate was at least 3 million at the time and growing - see https://en.wikipedia.org/wiki/Danny_Tate). The conservatorship intentionally and premeditatedly plundered his estate, rendered him homeless and bankrupt, robbed him of his rights (including parental), intercepted his mail and songwriting royalties, ruined his successful award-winning reputation, framed him criminally, incarcerated him, institutionalized him and involuntarily medicated him with psychotropics (despite the courts’ own findings that placed him in the top one percent IQ bracket).

 

No there is no good in any Conservatorship - they destroy what they have promised to preserve and protect. They destroy the very heart and soul of the conservatee, as well as their assets. The conservatee’s OWN MONEY is used to pay the costs. All conservatorships and guardianships are illegal because they do not afford due process and they violate constitutional and human rights. They all utilize Probate which is a liquidation of assets - this is the complete antithesis of “conserving”.

 

In his book "Fugitive from Injustice", Danny Tate reveals how predators, in the form of judges, attorneys, ill-intended friends and family members, doctors, psychiatrists, law enforcement, government officials, banks, public and professional guardians and other fiduciaries participate in conservatorship / guardianship abuse and commit legalized robbery. With all due respect, empathy and sincere hope for freeing Britney, Britney's conservatorship is a walk in the park compared to Danny's.

 

Danny’s ebook has additional links to things like the “emergency” ex parte hearing (a hearing that takes place in secret without the potential conservatee’s knowledge) which was a mere 18 minutes long (mostly of small-talk and joking), and without Danny present to defend himself, and without any evidence of the need for a conservator, placed him under conservatorship, after which his bank accounts were seized. As in all conservatorships, his own funds were used to pay the lawyers and court costs. When that ran out they tapped his retirement savings and then sold his house. (Danny's own attorney bought Danny's house and lives in it.) Since he was then homeless, he lost custody of his young daughters. It's an unconstitutional, illegal and corrupt system utilizing holes in the law, facilitated by probate and judges, attorneys, doctors, guardians / conservators, law enforcement, and family members who are either ignorant, uninformed, ill-intended, or crooked and in cahoots. It could happen to anyone with money. (This happens to the main character in the movie "I Care A Lot”.)

 

Another thing to mention is that a lot of advocacy groups are misinforming the public and do not have the victims’ best interests at heart.
