    Breaking: Judge Rules Kesha Defamed Dr. Luke

    A judge ruled Kesha defamed Dr. Luke and also cited a breach of contract after she texted Lady Gaga that Katy Perry was raped by Dr. Luke. 

    She must pay $373,671.88 in interest for breaching her agreement and failing to pay him $1.3 million royalties. 

    According to previously-filed legal documents, the text Kesha sent to Gaga “falsely stated that another female recording artist [Katy Perry] had been raped by Gottwald, and again repeated the baseless assertion that Kesha had been raped by Gottwald.” Luke adamantly denied the claim and asked a judge to allow him to add a defamation claim to his ongoing lawsuit against Kesha for the “malicious purpose of further damaging [Dr. Luke’s] reputation and business.”

    The text that says the other recording artist was “raped by the same man” did not specifically state his name, but Luke's legal team says it's clear he's the one being referred to.

    "There is no evidence whatsoever that Gottwald raped Katy Perry or that Katy Perry, whose sworn testimony is unrelated, must not be believed," the newly-filed docs say.

    “Today's important decision by the Court in Dr. Luke's lawsuit brings him closer to the justice that he seeks,” Dr. Luke’s attorney Christine Lepera said in a statement. “First, the Court has now ruled that Kesha made a false and defamatory accusation about Dr. Luke when she baselessly claimed that he raped Katy Perry.  Second, the Court rejected Kesha's attempts to invoke legal technicalities to avoid responsibility for her statements.  And third, the Court also correctly held that Kesha breached her contract with Dr. Luke's company.”

    In 2018, a judge unsealed several pages of Katy Perry's testimony in the Dr. Luke x Kesha legal battle (despite the pop star formally requesting the entire document remain under lock and key).

    According to the transcript, Perry denies the defamed producer having ever raped or sexually harassed her in any way, shape or form.

    Lawyer: Are you aware that Kesha has made a statement that Dr. Luke raped you?

    Katy: Yes

    Lawyer: Did Dr. Luke ever rape you?

    Katy: No.

    Lawyer: Did Dr. Luke ever sexually assault you?

    Katy: No.

    Lawyer: Did he ever give you a roofie?

    Katy: No

    Lawyer: Did you have a sexual relationship with Dr. Luke at all?

    Katy: No.

    Lawyer: A romantic relationship?

    Katy: No.

    Lawyer: So Ms. Sebert's statement that Dr. Luke raped you is false?

    Katy: Yes, ma'am.

     

    Dr. Luke's legal team emailed BreatheHeavy a statement at the time, saying:

    "In 2014, Kesha filed a bogus Complaint against Dr. Luke - which she has voluntarily dismissed - falsely claiming that he drugged and raped her in 2005. Now, after four years of litigation, it is Dr. Luke's defamation claim that remains. Evidence is now publicly available to show that Kesha's Complaint was filed pursuant to a "Press Plan" and PR media blitz, designed to create the maximum negative public pressure on Dr. Luke in order to get him to give in to her contract demands.

    Having done all of the damage publicizing her false claim of rape for years, Kesha now has asked Dr. Luke to not speak publicly about the evidence just being revealed... even though this is the first time Dr. Luke has the opportunity to do so with some of the actual facts. Ironic, indeed."

    Now Katy Perry can go back to making hits with him without feeling worried about backlash!

     

    Imagine if the man that ***** Gaga was Dr. Luke and her not willing to ever speak who he is, ruined Ke$ha...:joanne:

    Here are the full court docs. The judge ruled that she defamed him. 

    As for the allegations that he ***** Kesha, which is what you might be referring to, that's still up in the air.

    Notice you're the only source using "found guilty" because the Katy Perry text is 1 part of the entire lawsuit. That point doesn't need to be argued at trial anymore, but that doesn't make her "guilty" overall, as you are implying. Many are interpreting your headline as this being the end of the road, and it absolutely isn't. The judge is setting rules for the trial, not making a final judgement.

    I see where you're coming from. I jumped the gun a bit with the headline. In my mind I thought, 'the judge found Kesha guilty of defamation.' I would like to point out though that everywhere this story was pushed on social media, it framed the headline – that this was about the Lady Gaga text about Katy Perry. But I hear you, and I'm sorry about the confusion / slight misleading headline.

    Saying something defamatory =/= her being guilty of defamation, which is why your headline is completely misleading. The judge ruled that she said something defamatory, which isn't the same as finding her guilty of defamation.

    I don't find it completely misleading, but as I mentioned I agree it needed to be adjusted. The opening line of the docs call it an action of defamation and breach-of-contract

    yes... an action of defamation doesn't mean she is guilty of defamation, because an overall judgement has yet to be made

    It's not misleading! She was ordered to pay...I would say that goes along with your headline.

    Yikes. I really hope not, but it’s looking like Mama lied about everything. I’m interested to see if this goes to court. Dr Luke may have super shady(although legal) practices, but if she lied about all of this, then she’s the biggest slime ball of them all.

    Say she did intentionally lie about Katy, that doesn't mean her claims she was ***** her false, either. I'm not sure how a jury will proceed. Kesha will have to provide definitive proof somehow and that doesn't appear to be possible.

    Y'all, this case is very problematic.  In a perfect world everyone would be honest but we know how scummy the industry and people who want to be in it can be.  At this point, move on.  They all took a career hit due to this, honestly.  I do believe Dr. Luke is prob a rude person and I believe Kesha is wishy-washy in things that she says.  I was a fan of their work together.  Hopefully they move on now.

    Men in Hollywood have lost everything they've had because of accusations from victims.  Most of them didn't even go to court

    Interesting precedent though. At the time Kesha posting the screenshot, judge ruled that the intent of posting the screenshot (regardless of validity) was to slander Dr. Luke, not to build a case for herself.
