It's official: All past NDAs are now (potentially) illegal per the National Labor Relations Board

Theoretically speaking there's no longer anything preventing people that were involved in the conservatorship from speaking up other than any potential BS defamation lawsuits that will most certainly arise now that this motion was filed

The general counsel of the National Labor Relations Board issued a memo this week clarifying one of the biggest open questions after the NLRB rules broad non-disparagement clauses were illegal.

 

Quote

"[…] the decision does, in fact, have “retroactive application,” meaning that already-signed and “overly broad” non-disparagement clauses are no longer considered valid by the NLRB."

"[…] employers who attempt to continue to enforce illegal severance clauses could face trouble from the NLRB. While the NLRB typically has a six-month statute of limitations for labor violations, businesses who attempt to enforce illegal parts of an older severance agreement would be committing a contemporary “violation” and subject to enforcement"

"Additionally, [General Counsel Jennifer Abruzzo] provided clarification around what non-disparagement and confidentiality clauses may still be considered legal. The provisions, she said, must be “narrowly-tailored.” In the case of confidentiality, the clause must serve to keep proprietary trade information secret “for a period of time based on legitimate business justifications may be considered lawful,” but must not have “a chilling effect that precludes employees from assisting others” or communicating with the media, a union, or other third parties."

She definitely won’t speak and absolutely doesn’t need to. She saw nothing.

She doesn’t need to, but she saw plenty. Everyone that has dared to say something keeps it vague, but the consistent story is how ‘out of it’ she was during this period and how controlling everyone was around her. There’s no way Britney was just magically ‘normal’ and everyone was treating her like an adult for this awards show. She was given a tight leash and barely allowed people near her.

That's great.

However,

I do think that the reality is that not many people will actually speak up for Britney. Everyone has their own life to defend and take care of, to fight for and everyone may have a different experience. And knowing how corrupt the world is, even with the safety of being legally able to speak doesn't mean there will be 0 consequences after all, so maybe they'll just mind their own business for their own convenience. And that seems like such a selfish and rude thing to do, but even us as normal people don't go speak towards everything in the world that seems cruel and seemingly illegal. It will be difficult to distinguish who is just quietly supporting her to who was complicit with team con, or who wasn't complicit but is just selfish etc., but I think Britney herself will know and deal with it on her own. Those who acutally did and will voice their support is incredibly brave and courageous and deserves praise, but I worry some fans might bombard some people for not being vocal publically, thinking not speaking means they are suddenly 100% team con. (The logic for some people here are quite toxic ya know...)

I hope more people do speak up amd show support, but hope that we focus on them, instead of who didn't.
