the beginning: Hon Penny made a tentative decision about tri star that was very pro tri star and anti RosenGOD/Britney.

many judges are unwilling to change a tentative decisions bc of ego…but as Emily D Baker points out in her last Britney review, Hon Penny totally is willing to change the tentative decision if the facts support the change.

so Rosengart wants to review the CON for fraud etc and get all relevant info for the CON since the inception (2008). Tri Star’s attorneys wants only 2019 (12th accounting) to be reviewed in deposition. Tri Star argues that the court already approved accountings 1 thru 11, so the info relating to those years (2008-2018) should be irrelevant in discovery.

in order to open up the past accountings for review (Tri Star information 2008-2018), RosenGOD needs to prove that Tri Star had a fiduciary duty to Britney.

IMHO RosenGOD did an amazing job arguing that Tri Star has a fiduciary duty to Britney.

AND then the surprise info bomb was that Jamie revealed info in his deposition that IMPLICATES Tri Star (allegedly). Rosengart asked to clear the court so that he could disclose the info to Judge Penny. THIS was the moment of the power shift IMO. TRI Star started running scared and got caught wrong footed IMHO.

Judge Penny did not allow Rosengart to clear the court to reveal the info. But tri star lawyers were scared…and this is when they started fumbling (IMO)

and then they made a MAJOR mistake (allegedly) (IMO). 

Soooo, even tho no decisions were officially made today, there was a major power shift. IMO by the end of the hearing Tri Star’s lawyers are scared, and at the beginning of the hearing the were smug.

The mistake Edelman (Tri Star’s attorney) made was stating (paraphrased) “Rosengart is fishing for information starting in 2010.” He did not say 2008, AKA when the CON started. IMHO That implies Tri Star’s attorneys are most concerned with discovery of info starting in 2010. WELL in 2010, there happened to be an extremely significant accounting change that made it easy for Tri Star plus the CONs to hide financial transactions from the court.

edelman’s mistake IMHO was saying 2010, not 2008…there was NO other significant change to the CON in 2010, other than the accounting definition change.

If the judge said she wasn’t comfortable clearing the courtroom then Rosengart never told her what Jamie said?

Correct…tri Star attorneys and judge Penny were caught off guard when Rosengart said this…I assume Rosengart will have the opportunity to reveal this info to judge Penny (even tho it did not happen today)

I don’t understand why Judge Penny felt uncomfortable clearing the room, was she not interested in knowing what Jamie said? Smh

Rosengart had the courtesy to let her know there was a big discovery that needed privacy to be discussed, he could’ve easily just drop the bomb instead (which would’ve been juicy).

This is just taking too long, a public bombshell is needed to move things to a faster pace like Britney’s public testimony. The media is losing interest and Lou Taylor and TriStar aren’t being talked about enough.

People have to remember that MR knows what he is doing and when and where to reveal what. To show all his cards and let the public in on more than he is ready to do could impact the whole case. Could also impact potential whistleblowers and things like that.

When/how would he reveal the info to the judge? Is she allowed to read the deposition? Or I assume he'd file it within the courts? Is that something he'd have to wait for the next court hearing to reveal or how would he bring it up now?
