well, even if he presented his resignation it wasn't gonna be approved immediately, but he's saying he'll be cooperating with Rosengart, so they can't backtrack from that. 

If Judge Penny decides he needs to leave, they won't be able to contest now and say like "wait, but-" because they're already accepting it here. 

 

Of course they won't give Rosengart 100% the reason, because that would be accepting he's guilty of everything else that is written on Rosengart's document.
