Explain to me Rosengart’s rights vs Jodi’s vs Jamie’s

Recommended Posts

Until now Britney’s conservator of person (Jodi), conservator of estate (Jamie Spears) and former lawyer (Ingham) have been an united front working together to keep Britney in the conservatorship and voicing publicly her true feelings.

Now that she has a lawyer who is actually advocating for her, what kind of power does he have?

What kind of rights Jodi controls as the conservator of person?

According to the court she can’t deny Britney from getting married or having babies.

According to Adam Streisand (who tried to rep Britney 13 years ago) Jodi  doesn’t have a right to prevent Britney from walking out of the door (driving) or posting online what she wants.

Jamie can control Britney financially by refusing to pay gas for her car or phone bill. Since he controls the company that apparently owns Britney’s Instagram account, he may be able to decide what get posted and what not – although I’m not 100 % sure how copyright issues etc work in this case.

Britney has a right for unrestricted and unmonitored access to her lawyer. This was said in the court documents.

Rosengart can petition to remove Jamie and petition to end the conservatorship. He has to accept on Britney’s behalf Jodi’s extra security. He can give public statements on behalf of Britney.

What else can he do?

Jamie owns Britney Brands, that means he controls everything related to her career / business / image / social medias / public appearances / interviews

Rosengart has no power over the conservators Jamie & Jodi, but he can negotiate with them or with the court, if he wants to give more rights to Britney.

But ultimately, the court would have the last word

This isn't very clear though. We know from leaked documents from 2014-2016 that they tried to prevent her from getting married, the judge even instructing her lawyer (Ingham at the time) to not made her aware that they didn't have that right making her believe when they said they could stop her from getting married.

In the initial documents of the conservatorship it does state that she "lack the capacity to give informed consent for medical treatment" (basically meaning they could force her into it) and that she is "unable to properly provide for his or her personal needs for physical health, food, clothing, or shelter." And based on that the jugde did grant conservator of the person powers to control who Britney could talk to, where she could go, who could come to her house and other very restrictive powers. Now it's unclear how much of that has changed but her conservatorship continues to be of the most restrictive type. What makes everything confusing is that they labeled it "voluntary conservatoship" after it was made permanent theorically meaning she consents / agrees with it which clearly is not the case... so basically she is in legal limbo and that's where Rosengart has powers to act, he can review every aspect of it which clearly wasn't reviewed by Ingham and demand more clarification and justification from the court and the other parties. Example, she is deemed incapacitated on many instances yet there is no declaration of capacity meaning these notices are arbitrary and lack juridical fundament. That could've been explored by Ingham but we all know his loyalty was on Jamie's side. Now with a proper lawyer all of that can be explored, clarified and addressed. My guess is that this is precisely why things are changing on her life such as she's driving and being "allowed" of doing things she previously was being denied to, because now her lawyer can properly argue that there is nothing on the documents granting conservators such powers and obvly her team always knew that. Ingham just wouldn't do it for her.

He has no rights to help her outside of the courtroom atm. He is not part of the cship. It's still controlled completely by Jodi and Jamie, nothing has changed because there has not been a court date since Britney was able to hire a lawyer. What Rosengarten can do is point out to the judge if he sees any wrong doing, he can't act on it in the moment, he has to wait to get permission from the judge.

Basically nothing has changed, Rosengart has not even filed the petition to end to cship yet.

The changes we've seen like her driving are decisions made by Jodi or Jamie.

So Jamie does own Britney Brands or is he only owner because he is conservator of estate? When Britney is free will Britney Brands be in her possession? That would be so eff'd up if Jamie still owns her as a brand when she gets freed.

He only owns it because she is the conservator. It wouldn't be that way without the cship.

I think he'll still own Britney Brands even if he is not conservator of her estate anymore... But I'm not 100% sure

One would think that Jodi would be now very careful not to make any (more) mistakes that could end up in court documents, because she is a professional conservator and doesn’t seem to want any more damage to her reputation.

It seems to me that a lot of their control has been based on them telling that Britney can’t see her kids or will be sent to a rehab or just letting her assume that she isn’t allowed to do certain things.

So just Rosengart making Britney aware of her rights and the knowledge that he will bring any wrongdoing in court can (and perhaps has) already changed things for the better for Britney.
