Jodi Montgomery responds to Jamie's response in seething fashion: "Ms. Spears wants her father to go, but he won't..."

Britney's personal conservator, Jodi Montgomery, lashed out at Jamie Spears in new court docs. Jamie recently pointed the finger at Jodi claiming she's one of the reasons why Britney's situation is so dire. Jodi is not having it.
  
The court docs read:

"Despite what Mr. Spears says, as of the date of this filing, Ms. Spears wants Ms. Montgomery to stay; the same cannot be said for her father."

She adds: "Ms. Spears wants her Father to go, but he won't... Ms. Spears does not want her father in control over any aspect of her life as conservator over the Person or Estate. Indeed, Ms. Spears has sent Ms. Montgomery countless messages expressing her wishes to remove her father as her conservator in any capacity. 

"Mr. Spears has never been willing to relinquish control - he has been either her sole or co-conservator since the start more than 13 years ago!"

"Indeed, for the very first time, in his response filed with this Court, we learned that Mr. Spears has no intention in serving in the role Conservator of the Person for Ms. Spears. This comes as a surprise to Ms. Spears' care team. And, notably, despite this stated intention, he has never submitted a formal resignation. Instead, he has left that possibility open in the event that his nuclear litigation and PR strategy - funded with more Thant $2 million of his daughter's money - forces everyone else off her conservatorship case. That strategy will not work with Ms. Montgomery, She is committed to staying (despite the numerous threats against her) so that she can seek a re-evaluation of the powers and restrictions currently in place in a new Care Plan, with the goal of eventually terminating the conservatorship - a goal that may not necessarily be shared by Mr. Spears and his attorneys." 

The doc ends stating it's imperative Britney be allowed to hire her own legal counsel of her choosing. The next court hearing is July 14th.

Jodi Montgomery's reply to James P. Spears' response to court-appointed counsel Samuel D. Ingham petition for appointment of Jodi Montgomery as conservator of the person. 

 

Jodi Montgomery ("Ms. Montgomery"), as Temporary Conservator of the Person of Britney Jean Spears ("Ms Spears"), hereby replies to James. P. Spears("Mr. Spears"), Conservator of the Estate of Britney Jean Spears, Response to Court-Appointed Counsel Samuel D. Ingham III's Petition for Appointment of Successor Conservator of the Person (the "Response"), and allege as follows and states as follows: 

1. How has it come to this? Mr. Spears, as the Conservator of the Estate, and Ms. Montgomery, as the Conservator of the person, should be working as a team to ensure that Ms. Spears' best interest are being met, that she is on a path to recovery and termination of her conservatorship, and that she is living her best life possible. Instead, Mr. Spears has decided it is time to start the finger-pointing and media attacks (even opposing Ms. Montgomery's security amidst a flood of death threats), turning what should be a protective proceeding for his daughter into litigation warfare. In the process, he has demanded multiple evidentiary hearings to defend himself against Ms. Spears' accusations (on her dime) and has spent $10,000 a workday )also on her dime) to fund his public relations and legal fees. The mud-slinging by Mr. Spears and his new "It wasn't me" strategy -- after being her sole co-conservator for more than 13 years - leaves Ms. Montgomery no other choice but to defend herself. 

 

2. Ms. Spears Wants Ms. Montgomery to Stay - There is no question that Ms. Spears voiced her displeasure with the constraints of her conservatorship at the June 23, 2021 Hearing. Nonetheless, Ms. Spears has been in constant communication with Ms. Montgomery since then, and she continuously asks Ms. Montgomery to help her with various matters related to the conservatorship. Notably, she has never asked Ms. Montgomery to leave, and Ms. Montgomery is committed to assist Ms. Spears in any way she can until Ms. Spears says she wants her to go. To this date, that has not happened. On the contrary, as recently as Friday, July 2, 2021, Ms. Spears asked Ms. Montgomery to stay. (See Exhibit A, a true and correct copy of a text message between Ms. Spears and Ms. Montgomery.) Since by his own admission he has been cut-off from communicating with his daughter - at her request -- it is unclear how Mr. Spears knows that the retention of Ms. Montgomery "does not reflect her wishes", as he now claims. (Response, p. 2, lines 12-14, 21-23.) Despite what Mr. Spears says, as of the date of this filing, Ms. Spears wants Ms. Montgomery to stay; the same cannot be said for her father. 

3. Ms. Spears Wants Her Father To Go, But He Won't. It is ironic that Mr. Spears now wants the conservatorship to "reflect her wishes", since it is no secret that Ms. Spears has wished her father out of her life for years. If the June 23, 2021 Hearing showed anything, it was that Ms. Spears does not want her father in control over any aspect of her life -- as Conservator of the Person or Estate. Indeed Ms. Spears has sent Ms. Montgomery countless messages expressing her wishes to remove her father as her conservator in any capacity. 

 

4. Despite this new-found commitment to "her wishes", Mr. Spears has never been willing to relinquish control - he has been either her sole conservator or co=conservator since the start more than 13 years ago! Indeed, for the very first time, in his Response filed with this Court, we learned that Mr. Spears has no intention in serving in the role of Conservator of the Person for Ms. Spears. 4. Other Potshots and Innuendo in Mr. Spears' Response - Ms. Montgomery did not want to engage in a "***-for-tat", but having seen Mr. Spears' innuendo in his Response, Ms. Montgomery, as a professional fiduciary, feels forced to respond as follows. 

a. Mr. Spears' Demand For an Investigation and Evidentiary Hearings: Mr. Spears' repeated demands ignore the fact that, as required by Probate Code Section 1850, this case has been investigated by the Court on an ongoing basis since its inception. In fact, it is our understanding that the Probate Investigator's Office has investigated this case at least annually, if not more frequently, since 2008. In light of these investigations, Mr. Spears' current demand can only be a thinly veiled attempt to use his daughter's money to defend himself against her accusations at the June 23, 2021 Hearing. If this Court does order additional investigation, perhaps it can begin with who Ms. Spears wants to serve as her Conservators until her conservatorship can be terminated. 

 

b. Medical Powers: Mr. Spears implies that Ms. Spears' own counsel and Ms. Montgomery have conspired with respect to Ms. Spears medical powers. As Mr. Spears well knows, Ms. Montgomery is currently preparing a comprehensive Care Plan with Ms. Spears' medical team that will address all the issues raised by Ms. Spears at the June 23, 2021 Hearing, including those that relate to her tenure as Temporary Conservator of the Person. The medical team will also address the need, or lack thereof, for medical powers under probate Code 2355. The Care Plan will set forth a path for termination of the conservatorship for Ms. Spears, and Ms. Montgomery looks forwards to supporting Ms. Spears through that process. 

 

c. Mr. Spears' Invented Ignorance of Anything in the Last 21 Months: Mr. Spears points fingers at Ms. Montgomery, implying that for the last 21 months he has had absolutely no involvement in Ms. Spears' day-to-day personal care and medical treatment. But this ignores the simple fact that everything costs money. Because Ms. Montgomery does not have any power or authority over Ms. Spears' money, every expenditure made by Ms. Montgomery for Ms. Spears had to be first approved by Mr. Spears as the Conservator of the Estate. Some expenses are pre-approved but if new services or an increase in existing services is sought, Mr. Spears has to approve that expenditure. No expenditures can happen without going through Mr. Spears. Ms. Montgomery has advocated on Ms. Spears' behalf for any expenditures that Ms. Spears has requested as well as for expenditures recommended by Ms. Spears' medical team. Not every requested expenditure has been approved, leading to some of the concerns raised by Ms. Spears on June 23, 3032. 

 

d. Mr. Spears Has Been "Cut-Off" by Ms. Spears: Mr. Spears implies that Ms. Montgomery or others have prevented Ms. Spears from contacting him. (Response, p.4, lines 1-2). What he fails to say is that Ms. Spears is the one who cut him off. Ms. Montgomery has never interfered with Mr. Spears' communications with his daughter. Instead, consistent with Ms. Spears' clear and consistent wishes that she no longer wants her father serving as her conservator, Ms. Spears has also made the choice that she does not want to speak to him. That is her choice, not Ms. Montgomery's. 

 

e. Ms. Spears Has Always Had the Right to Marry: Mr. Spears claims that only he allowed Ms. Spears to marry, implying that Ms. Montgomery somehow interfered with that right. That is simply not true. Under Probate Code Section 1900, Ms. Spears has always had the right to marry, and Ms. Montgomery, asa professional fiduciary, known and honors that. 

 

5. Conclusion: Notably, Mr. Spears' pleading is entitled "Response" and not Objection, leaving the Petition still unopposed. And we do agree with the Response's request that the Petition should be continued, but for a different reason: to allow Ms. Spears to secure new counsel to represent her on all pending matters, including the subject Petition. This is especially critical since Mr. Spears is now requesting yet another evidentiary hearing -- to be funded by her -- in this Petition as well.
