US Senators Elizabeth Warren, Bob Casey Ask For Data on Conservatorships After Britney Spears Testimony

Senators Elizabeth Warren and Bob Casey want more federal oversight of the country’s guardianship system following Britney Spears’ emotional testimony about her conservatorship, they wrote in a letter on Thursday.

The lawmakers are calling on the Department of Health and Human Services (HHS) and the Department of Justice (DOJ) to provide information about data the agencies collect on the prevalence of guardianship in the U.S, any efforts the agencies have made to protect people under guardianship and ways Congress can improve federal collection of guardianship data.

“Ms. Spears’ case has shined a light on longstanding concerns from advocates who have underscored the potential for financial and civil rights abuses of individuals placed under guardianship or conservatorship,” Warren and Casey wrote in a letter shared exclusively with TIME. “Despite these concerns, comprehensive data regarding guardianship (referred to as conservatorship in some states) in the United States are substantially lacking—hindering policymakers and advocates’ efforts to understand gaps and abuses in the system and find ways to address them.”

Just to kind of summarize my own thoughts on this; This is very very good news. Her case is actually reaching the federal level and two United States Senators have formally submitted their own investigation to the US Attorney General and Secretary of Health and Human Services. 

 

As you can see in the letter, they got super specific with what data they wanted to extract. Very helpful first steps when crafting legislation. We'll see what comes out of it, but if we're actually looking for real change from the top, this is a great first step 

They also ask for a hard deadline of July 14th to get this data, which is good

Agreed! Data is important because of they’re going to craft legislation to regulate conservatorships, they need to know the landscape out there. I think it’s also important how they say each state court approaches conservatorship differently. If federal legislation can help guide or dictate conservatorship across the country more uniformly, maybe corruption could be reduced.

Yeah, I've seen her work and prodding of bankers and corporate execs when dealing with the housing crash of 08 and she helped with the creation of the consumer financial protection bureau , which helps regular folks with legal battles on payday lenders, credit cards, etc. Financial corruption is her wheelhouse

this is a serious issue in the US, and much bigger than most people think 

I really hope that besides Britney getting freed, there's a reform in the conservatorship law and the institutions that are supposed to check that things go alright

They're elected officials that write and vote for federal laws. Each state elects two, so there are 100 in total.

We have three branches of government, which is supposed to be a system of checks and balances on the other two branches. We have a judicial branch (supreme court, judges), executive branch (president, vice president, and their cabinet of people), and legislative branch AKA congress. Our congress is made of the House of Representatives and the US Senate. The legislative branch votes and enacts policies that both the Senate and House come to an agreement, which then gets sent to the executive branch from approval.

What's the difference between what the Attorney General does and that Jerrold Nadler guy (House Judiciary Chairman), the one Matt Gaetz was asking to host a  hearing on conservatorships & Britney to speak?

Attorney General heads the Department of Justice, which includes agencies like the FBI, among others. Attorney General is a top tierhead honcho position, while Jerrold Nadler is a regular state rep in the House of Representatives (which is one half of the legislative branch i mentioned above) House reps are voted into these groups called subcommittees, where they conduct hearings for their specific subcommittee.  House Judiciary is one of those groups
